    Default Alienation of Affection and Criminal Conversation

    Is alienation of affection and criminal conversation legal in Florida? I am the one who had the affair, what charges can the wife file against me? She says prostitution and extortion. The affair lasted for 3 1/2 years and produced a child. I don't want my son in the middle of this. Also, the guy purchased a home for me and our son--which I have been making the mortgage for 2 years-the wife says she wants me out in 2 days. Can she kick my child and me out?

    Default Florida - Alienation of Affection & Criminal Conversatio

    Pursuant to Florida Statute, enacted in 1945:
    Quote Quoting Florida Statutes, Torts, Section 771.01 - Certain tort actions abolished.
    The rights of action heretofore existing to recover sums of money as damage for the alienation of affections, criminal conversation, seduction or breach of contract to marry are hereby abolished.
    If you have been residing in the house for 3-1/2 years, she probably would have to go through an eviction process to make you move. If the home is exclusively in your boyfriend's name, she probably has no present legal right to make you move.

    thank aaron,

    I know what we did was not right--however, he is trying to do right by his child. She is telling him that he will have to sell this house and I will have to move--or she wants to move in her (weird). If the law is 50-50--can't he just buy her out? They own their primary home and a summer home.--so he has plenty of options. Also, can she charge me with prostution and extortion? That is what she is yelling. Will I have to testify in court? She is the one filing for the divorce.

    also--on the house--what happened was, my credit was bad, so he agreed to purchase the house in his name until my credit was cleared up. In the meantime, I have made 2years mortgage payments. However, I think in FL you have to list your spouse for a loan, which he did not, he listed single. What recourse do these actions have?

    If the matter goes to trial, or if depositions are held, you may be called as a witness.

    If you are not on the title, and have no written agreement, it could be difficult for you to make any claim in relation to the house. Whatever his interest, its division will be resolved through his divorce.
