    Default Does Roommate Owe Security Deposit Refund

    I lived in a rent stabilized apartment in NYC, where both my roommate and I cosigned a lease. At the end of the lease term, I moved out, and he remained, crossing my name out on the lease renewal. After I moved out, and despite his promises beforehand to the contrary, he refused to pay me my half of the security deposit, saying I'd get it from the management company whenever they refund it.

    However, I've talked to the management company, and they won't refund it until he vacates (he just signed a full-year lease), saying he's supposed to refund it to me.

    Do I have a legal right to recover it from him, especially since he told me he'd refund it when I moved out?

    Your roommate crossed your name off, but did the landlord expressly approve the change?

    No, the landlord's told me that I still have a right to the apartment, though I'm not liable for rent. The apartment is rent stabilized, hense my having a "right" to the apartment. I could only lose that right by expressly signing it away, which I refuse to do before I receive my half of the deposit.

    You have deliberately remained a tenant, so the landlord has the right to refuse to refund you anything. The rest is between you and your roommate. If you wish, you can try enforcing the promise for the refund of your half through small claims court.
