But I technically did not replace my old roommate. She is still on the lease, she just isn't living here anymore. Correct me if I'm wrong, but in our lease it states that we are liable for 12 months worth of rent. She signed the lease stating she would pay for 12 months. Technically she didn't sign saying she would stay, but she did sign saying she would pay. Not to mention, no one finds it unfair that she can just up and leave on the lease without paying a dime, leaving us responsible and if we were to move out we would have to pay the remainder on the lease? I find it fair that if we want to move we must pay the remainder of our lease out... why doesn't she have to abide by that part of the lease?
Is the new roommate sleeping in the second bedroom?

stop with the games. You DID replace her. She stays in the former roommates bedroom, right? She has displaced the old roommate.

Additionally no doctrine in law would allow you to accept payment from the new roommate AND expect the former roommate pay rent the new roommate is paying.

What you dont understand is that if you would up and move (in breach of the lease), all tenants signatory to the lease would be jointly and severally liable for the damages. The landlord has the option of seeking payment from all or any individual tenant he chooses to go after.
