    Exclamation Landlord Charging Excessive Repair Costs After Moving Out

    My question involves landlord-tenant law in the State of: Florida

    After living for 4 years, minus two months, the landlord charges me for replacing stone tile claiming they smelled like cat's urine, replace a refrigerator claiming tropic fruit flies living in it, claiming replacement carpet, and much more. There was no co-inspection as final inspection. Can they do that? Can I counter sue for fraud? We move out exactly on the 30th of the month but was charged $800.00 extra. Right now, the bill is over $10,000.00. Please advise.

    Well, did you have cats in the rental unit? Can a landlord charge for an appliance replacement if the tenant damaged it to point where insects are living in it? Yes (a prorated charge based on the age of the appliance). IS this fraud? We have no idea since we do not have the ability to view the condition of the rental unit at move out.

    Can you sue claiming fraud? Do you have evidence to dispute these claims by the landlord (for example, pictures of the rental unit at move out)? If so, these would be helpful in a court hearing.

    I have cats and a dog. We lived there for almost 4 years. The tile was stone tile. They claimed that it absorbs smell of the urine. The fruit flies cannot live below 65 degree Fahrenheit. It could not live in a refrigerator. It's too cold for that. The company has all the pictures. Their pictures show flies dead around the door not in side. Can you refer me to some of the cases that are similar to this, DoDact #?

    If it's un-glazed stone, you may well be on the hook. Cat urine CAN permeate stone, and definitely grout. Unless you have a way to document the condition of the premises when you left, you face an uphill battle. Why is the $800 extra being included?
