    Default Can You Go Back to Your Family Physician After Release by a Workers Comp Doctor

    My question involves workers compensation law for the state of: Mississippi

    Also if I am able to, will my Drs. Off work slop be upheld by the workers compensation commission

    You can always go to your own physician on your own dollar.... even while on WC. Is this for something related or unrelated to your WC injury?

    That said, have you been fully 100% released with a MMI/settlement OR 100% released fit for duty? Or are you looking for a 2nd/3rd opinion about your WC injury?

    Mississippi has a very loose rule for picking your own doctor but you didn't do that originally. You went with the Dr. assigned and he has released you to full duty.

    You posted in another forum that you have legal counsel you need to use it. And if your real name is the same as your screen name you need to realize that a Google search could find your posts in this forum and could be used in court.

    "The Workers' Compensation Law provides that an injured worker has the right to select one physician or medical
    provider of his or her own choosing to render treatment. This chosen provider may make one referral of the worker
    to another specialist to continue treatment without any approval from the employer or its insurance carrier. However,
    any additional selections or referrals must be approved in advance by the employer or its insurance carrier."

    A dispute between medical opinions can be resolved by the work comp court.

    Doubtful they will take your evidence over the other more favorable opinion. It would be very difficult to justify to the policyholder.
