    Default Custodial Parent Working and Not Reporting Wages

    My question involves a child support case from the State of California. My husband pays an ex child support for 2 kids. At the time the order was established she claimed she wasn't working. Even though she was under the table. She is currently working and isn't claiming that income. So how do we prove she's working to the courts without her giving the information?

    You don't prove anything. Your husband can file a modification of child support but if he has no proof of her income there's not much to happen. You can't prove her working without getting the information from her or she gives it to the court. I would think if he files a modification and the court orders her to show her income, she has to show it. But if she gets money "under the table" who can prove that? No one.
