    Default H1 Transfer Query

    Hi,

    I've obtained H1 through an employer 'X' and got the Visa stamped. I have not entered us yet (it has been aprroximately 3 months since I got Visa). While I'm still in my country I have got 2 more offers from different employers who are interested in getting my H1 transferred when I enter US.

    They say that H1 transfer is possible within the first one month of entering US by using the premium processing.
    Is it true?

    If so what is the risk invovled. Any suggestion is greatly appreciated.

    Premium processing speeds up the processing of the application. It doesn't change anything else. If the application is denied, with premium processing you should know within 15 days of the application. Consult the new prospective employers' immigration lawyers about their claims.

    In case the application is denied does that mean to say that my Visa is Invalid and I cannot work anymore with any Employer in US and I need to return to my country?

    Denial of a transfer wouldn't affect the underlying visa and authorization to work for the original employer.

    Thanks for reply.
    Final question is in case if Sponsorer (Company X through which I got visa stamped) comes to know about the transfer rejection and then he revokes my employment with them then in that case I cannot work for anyone else and have to return back?

    Correct. If you become unemployed you are to return to your nation of origin.
