Trying to be brief but thorough in this question. I have a 16 yr old that my ex-husband kept after visitation 12/25/05, since then I have tried going through the family court system to no avail. Now that I have only seen my daughter 3 times alone she states she no longer wants to live with me. My ex-husband has been ordered and threatened by the judge in our case to relinquish custody immediately. He refuses to comply. The police department will not physically take custody of her. A friend of mine asked her friend who is a police officer what to do. He stated that if in the next custody exchange, which should be this Thursday, that my ex once again does not comply, then drives off with her, that this is now considered child abduction since I have full custody of my daughter and should have had it for the last 16 months. This is the first I have heard of this re-course, before I do this I want to make sure I can do this legally. All the child abduction laws I have found refer to interstate or international abduction not if the parent remains in state.
Can someone please help?! I need to get my daughter in couseling ASAP to try to undo the damage that has been done. I believe her father teaching her to defy authority at this young age is going to be detrimental later.
