    Default What Can You Do if a County Refuses to Maintain a Road

    I purchased land in a subdivision in 2007. I at that time up until now was trying to build a barn for my horses and donkeys and other animals. I plan on building a house eventually to live there, however I'm trying to find out why the roads aren't being fixed.

    I combined my property to get the agriculture tax and I got it but since then they have changed it back I was paying 355.00 a year it was double that before I combined it now it has tripled and I have to protest or actually go up and file a denial on the tax assessment Also I've asked many neighbors about the roads and they were told they wouldn't fix the roads until we pay a lot more money to have it done. I do not live there just my livestock I am there every day.

    I travel 40 minutes there to feed and maintained my property and feed my babies. ( animals). But I'm paying school taxes there and at my home but not seeing anything that my taxes are doing to maintained the roads. We have road signs we have a name of our subdivision but I was told that the road that exits out
    On both ends to a county road was everybodies drive way and it was up to us to maintained it I was told we were sent a letter saying what all we had to do before they

    Would do anything I nor has anyone I have talked to has receive such letter I've talked to Commisioner and inspector also the courthouse they told me that it wasn't a county road We need help and don't know what to do. Please give

    If the county is not maintaining the road because it is in fact a private road for which the county has no responsibility, that would be the explanation. That would also appear to be consistent with the statements you attribute to your neighbors.

    If this is a private road, for which you and your neighbors are jointly responsible pursuant to deed covenants or some similar binding arrangement, then this is something you will need to work out with your neighbors based upon your legal duties as defined in the governing deeds and documents.

    Even if it was a public road, there's really no mechanism to compel the county officials to reallocate limited funds to prioritize your road over others that need maintaining. That is what elections are held for, to give that decision making power to the elected officials. Discretionary functions like road maintenance come under that category. The government is immune from being sued to force them to do things like that.
