My question involves criminal law for the state of: New York
From the DOC Inmate lookup:
Date received: 08/09/2013
Crime Class
ATT BURGLARY 2ND D
Aggregate Minimum Sentence 0000 Years, 00 Months, 00 Days
Aggregate Maximum Sentence 0002 Years, 00 Months, 00 Days
The judge gave him 3 years.
Conditional Release Date: 08/09/2014 (this was a Saturday, so they actually released him on 08/08/14)
Maximum Expiration Date: 11/23/2014
Maximum Expiration Date for Parole Supervision: None
Post Release Supervision Maximum Expiration Date: 08/08/2017
Violated parole on 06/12/17 for a CPCS-7, has been in county jail since then. Parole officer wrote a glowing review, model parolee and this is totally out of left field. Parole hearing was inconclusive, but the judge said if convicted, he will serve in prison until 11/23/17. He did have a co-defendant who was being represented by the same public defender so he asked for an adjournment to get a new lawyer for another hearing.
NYS Parole Handbook reads: If an inmate has a maximum expiration date, maximum expiration date for parole supervision and/or a post release supervision maximum expiration date, the latest date is controlling.
Doesn't that mean the latest date is 8/08/17?
