    Default Purchase of a Stolen Car That Was Later Seized by the Police

    My question involves a consumer law issue in the State of: colorado

    I bought a jetta from Mann number 2 and apparently man number 1 changed the vin to another lesser value jetta of the same model generation and the same color and gave him that title for 1500 i then bought the jetta for 4500 with a cashiers check from Bank of America and I wrote the VIN on the check it matched the vehicle itself and the title man number one found me on Facebook and threatened me and extorted me to trade him the Jetta I had the title for which was considerably lesser value for the actual car I purchased or I was going to jail also he said it was grey so I believe it was yet another card because my car and the title were red I was arrested on February 5th for aggravated motor vehicle theft spent a week in jail and within 24 hours of being incarcerated they released my car to Mann number one it is now July I went to court 9 different times and just pled not guilty last week and my trial is not till October

    I have never met man number one in my entire life and he claims I took the vehicle by force when I purchased it from Mann number 2 first question how is it possible that there was no investigation and they believe the nonsense story for man number 1 who my original lawyer told me is a schizophrenic and a drug addict that is involved in insurance fraud with one of the Jettas when I have never been in trouble in Colorado ever my only charge and my entire life was a misdemeanor in Florida how is he credible and I'm not and how could they give my car back without an investigation question number 2 have my rights been for a speedy trial I've been trying to plead not guilty since February and I just got to plead not guilty last week that's over 5 months and trial is set in October at the way it's going this won't be over till November the whole entire time the real criminal May number one is driving my car and pudding God knows how many miles and damages wear and tear also I had all of my tools my income tax check and many other personal items in my car the car was released to Mann number one less than 24 hours after I was incarcerated this whole time

    I've lost my job and I'm about to lose my home azeri direct result of the LIE man number one told the authorities third question when will I get my car back last question will he be responsible for my items and depreciation and mileage of my car I have submitted copies of the title that I received the cashier's check issued with the VIN number on it the threat given to me over Facebook by man number one and I'm still told I had to take it to trial my life has been ruined by this man I live in a rural area and have no way of getting by without this vehicle as I spent all of my savings on it I literally can't eat everyday because I can't afford food as a direct result by the con artist somebody please help me

    Your lack of punctuation and stream-of-consciousness posting makes it difficult to follow your story. It is not clear why you would by one car, then agree to trade it for another. If that second car was in fact stolen, and was in fact seized by the police as a result, you can sue the person who 'sold' you the car for the money / value you paid to receive the car from them. If you are stating that you were arrested based upon an accusation by the actual owner that you carjacked him, and are now facing criminal charges as a result, there's not much more to say than you need to work with a criminal defense lawyer.

    You should be able to recover your personal effects from the vehicle; if you chose not to do that and it is now too late, then get a replacement check from the IRS and I hope your tools weren't of significant value.

    I tried to clean it up some.

    I bought a jetta from Tim, and apparently Joey changed the vin to another lesser value jetta of the same model generation and the same color and gave Tim that title for $1500. I then bought the jetta for $4500 with a cashiers check from Bank of America and I wrote the VIN on the check. It matched the vehicle itself and the title. Joey found me on Facebook and threatened me and extorted me to trade him the Jetta I had the title for which was considerably lesser value for the actual car I purchased or I was going to jail. Also Joey said it was grey, so I believe it was yet another car because my car and the title were red. I was arrested on February 5th for aggravated motor vehicle theft, spent a week in jail and within 24 hours of being incarcerated they released my car to Joey. It is now July, I went to court 9 different times and just plead not guilty last week and now my trial is not till October.

    Question number 2. Have my rights for a speedy trial been violated? I've been trying to plead not guilty since February and I just got to plead not guilty last week. That's over 5 months and trial is set in October. At the way it's going, this won't be over till November. The whole entire time the real criminal Joey is driving my car and putting god knows how many miles, damage and wear and tear. Also I had all of my tools, my income tax check and many other personal items in my car. The car was released to Joey less than 24 hours after I was incarcerated.

    If you bought a vehicle with an altered VIN tag, then you bought a stolen vehicle.

    The color of a vehicle can always be changed, the VIN on a vehicle will always remain the same.

    Credible will come out in the court room, not in a police report. The police probably gave the car back to Joey because he is the legal owner, or the prosecutors office is holding the vehicle as evidence in the trial. Who said Joey has possession of the vehicle?

    No. In Colorado, the Speedy Trial Rights clock don't start ticking until the defendant pleads not guilty.

    The state has 6 months to bring you to trial from the day you plead not guilty. You plead not guilty last week, the state has to January of 2018 to bring you to trial, your trial is in 3 months. That sounds like a speedy trial to me, no?

    You are under the assumption that the vehicle is yours, if the VIN plate has been changed, it isn't your vehicle.

    I think you purchased a stolen motor vehicle, what has your lawyer told you?
