    Question Access to Property Blocked by a Security Gate

    My dad recently signed over a plot of land (5.03 acres) to me in Lake County, California. It's a bit inaccessible but in an area where there are tons of forested growth and it's on a hillside. It's prone to wildfires. We had a bad one several years ago.

    Here's my question: My dad told me that there is another group who owns land up there too. They have placed a security gate around their property but it also prevents me from accessing mine, at least a portion of it. When my dad told me of this, I was shocked that another property owner can erect a gate around theirs that interferes with someone else's. I called Lake County to find out where my property boundaries are. they said I would need to come down and take a look at some charts/maps to see (if they've been completed for my area.) Plus I wanted to find out how could I resolve this issue with removing this security gate from my property. Do I need to find out what the boundaries are first? Odd, that no one tried to ensure that no one else's property would be affected by a gate. Strange. Lake County said that it's normal.

    You need to understand just what is going on so yes, you will need to know what the boundaries are as well as any easements or right of ways that may be existant and where the gate/road you are using to access the property fits in all of that.

    If access to your property is through the use of an easement on someone else's property you are what is called a dominant estate. The servient estate (the property on which your easement lies) has a right to erect a gate and fence to protect their land. But they have to give you access ( a key or a combination) through the gate.

    What does "at least a portion of it" mean.

    If you have any access to your property at all, even if inconvenient, then you are not being kept from your property by the gate.

    Well, I last remember going there with my dad and we had to dial in a code to access it. I don't know if the gate crosses a portion of our property or not. I don't exactly know the boundaries of our property.

    Just to do the search probably runs a couple of hundred. If you need a survey to go with it, it can run over $1000.

    Of course, the other easier option is to find out who put the gate up and see if they will give you the code. That solves the short term problem.

    You can go to the registrar of deed in Lake County and see if there is a recorded survey of the property and it won't cost you anything. You may even be able to do it online.
