    Question How to Oppose Modificaiton of the Terms and Conditions of Your Probation

    My question involves criminal law for the state of: Missouri
    I was ordered 2 years on sis .The conditions of unsupervised probation for 2 years on the conditions of no additional animals .And the police can serch my auto or home at any time. And the prosecution attorney done a recent motion to modify my probation terms and conditions to no contact with ivey bend animal rescue and there employees.On July 5th. They we harrasing me .I have proff.I want to do possibly a motion to modify that I am allowed to have farm animals what do I need to do?And what do I say?

    You need to stay away from the animal rescue no matter WHAT provocation or proof you think you have. If they are harassing you, contact the police but do not respond to them. It's unlikely that the no contact order is NOT going to be approved.

    If you were on good terms with the PO (which I assume you probably are not given what's happening), then you could ask them if it were possible to modify the order. However, if those terms were set down by the judge in court, only the court can change them. If you feel strongly about it, you'll have to bring all your paperwork to an attorney.

    Okay I live in ivey bend development just like the ivey bend rescue.The jude is my probation officer.

    I have not gone near ivey bend animal rescue and there employees.They contacted me on a post I put on my facebook page that I stated that I was gonna take my pig to the butcher shop in 2 years and was harrasing me.The judge in the case is my probation officer.Me and ivey bend animal rescue and there employees all live in the same housing development.My husband is wanting to have additional coats , pigs , ducks , chickens. It is causing.problems in our marriage because the prosecution attorney put in the order that I cant have any additional pets.I done a motion but not sure how to upload it on here to see if its proper or not for court.still got to type it up.Its had written now.

    It doesn't matter. You can protest that you didn't contact them, they will say they did. Either way, the judge is likely to agree to the modification. If you weren't contacting them, you don't have anything to lose with a no contact probation condition.

    Again, as to the animal restrictions, you're going to have to make a separate case for that modification. Again, we don't have enough details to suggest if that's even possible. You'll need to have a lawyer that can examine the case materials.
