My question involves court procedures for the state of: Georgia

#1. What type of claim do I have.. The statement of claim has Suit on Note, Suit on Acount, Breach of Contract, and "Other".

What happened is that my wife was going to the doctor last year and we found out at the end of the year that the insurance had been paying them, and they were also charging us the entire mount, which my wife paid, and she should have only been paying our deductible. Se looked at the statement of benefit for the insurance and what we actually paid and it was around 500$ (forget the exact number but she has it). We have all the money we paid them from statements from the, as well as the SOB from the insurance.. We showed it to them early this year and they agreed to pay.. The check never comes. She's talked with them several times and they keep saying the check will arrive in 10 days, but it never does. We are no in to July, 7 months later. Last visit my wife gave them a demand letter, had the discussion with them again, and they agreed to pay, again..

Not sure what my claim would technically be called. Any help would be appreciated it.

#2. Who's name goes on certificate of service and statement of claim doc..

The company is a LTD Corp per the SOS website.. We know who the registered agent is. We all live in the same county and they do business in the same county as us as well.

I'm guessing that the only name and address for the statement of claim for the "defendant" would be the business name and address as listed on the SOS website.

The certificate of service is tricky for me as well.. There are two fields there, "defendants" and also one at the bottom for "Opposing Party".. Taking a guess here but think defendants should be the registered agent name only, and the opposing party should be the corporation name and address? Help would be appreciated here..
