    Default What Can Tenants Do if a Subtenant Won't Move Out After They Vacate

    My question involves landlord-tenant law in the State of: colorado

    My wife and I were renting a room out to a guy, I got a new job and he said he would move out at the end of the month. We had to leave for obvious reasons and moved out and got a place in another state. Now the guy will not leave, I told the landlord he was there still hoping they could work out renting the place out in the future but that didn't happen. So now there was a 3 day notice posted and I'm not even in the state.

    I have no idea what to do here? The landlord is going after almost 5k which I don't have to spend and he won't leave. HELP

    Unfortunately, if you bring in a subtenant, that's your tenant. If you leave your subtenant in possession of the rental unit, your tenancy continues until your subtenant vacates. If your subtenant does not pay rent, that obligation falls upon you even if you have moved out.

    And the landlord has no obligation to evict YOUR tenant while he has you contractually on the hook for the rent.

    You made a $5000 mistake.

    I suggest you contact a lawyer where YOUR tenant is located and hire him to file in court to evict YOUR tenant. Then you can sue YOUR tenant for the rent he owes YOU.

    Meantime YOUR debt to YOUR landlord has nothing to do with that.
