    Default How to Get an Amended Name Change Order

    My question involves name change laws in the State of: Arizona

    Hi all, first post.

    I got a legal name change in Yuma County, Arizona in April of 2014. I kept my last name, made my middle name my new first name, and got a new middle name.

    After doing all this, the same month I submitted a birth certificate correction form to the City of New York so I can get a new birth certificate and also get passport with my new name. New York rejected my birth certificate correction on the basis that I did not pay the correct filing fees.

    I lost interest and 3 years later (this past April), I decided to resubmit my birth certificate correction to New York again and I made sure I paid the correct filing fees. This time however they rejected me on a technicality on my name change court order: I had put my place of birth on my court order as New York, NY when according to the rejection letter, its supposed to be Queens, NY. They told me I need to get an amended court order now to reflect my correct birth city.

    I live in Phoenix now and have no time to go down to Yuma. I got in touch with someone from the yuma clerks office and she directed me to the website to get an amended petition and amended order but I have no idea what she was talking about as all I see is the name change document and that redirects me to maricopa county.

    Can someone assist me with what forms I would need please and where to find them? The lady told me but I just don't see them. Also Would I have to still go through Yuma county superior court or can I make it easier and do it in Phoenix where I currently live? Thanks!

    I have never seen a standard form petition for the modification of a name change order, and I doubt that you will find one. Odds are you will have to figure out how to draft a petition, or retain a legal professional to do so on your behalf.

    I suggest you take all your Yuma papers, your birth certificate, other applicable documents and visit one of the Maricopa County Superior Court locations and inquire about this. Don't rely on phone calls. The clerk might not want to give you "legal advice" but you won't know until you try.

    Worst comes to worst, since you have to get the court involved anyway, is you might have to start all over again:

    A court clerk should not provide legal advice, no matter how hard you try to get it. Doing so is improper, and can get the clerk fired.
