    Default Does a Former Employer Have to Provide a Report of Earnings Records

    My question involves labor and employment law for the state of: .CA

    Hello again! As it turns out, past employees can be a handful..

    Today I received a letter in regards to yet another past employee. It is from the county, and it requests an earnings record for his employment. The words "please" and "request" is used many times in the letter, which leaves me to understand that it may be optional? Then it asks me to "please respond by 7-11-17". It also states that if I have any questions, I can contact their office at.. no phone number. I'm sure this is a legit letter, and I map searched the address of origin and it is a County health branch.
    Do you think it would be in my best interest to provide this information, and what do you think the goal is for them having this information? Thank you again!

    So far, my experience with getting letters about former employees from government agencies has been singular.. they want free money without having to work. So you don't think that's what this is?

    Not if it's coming from the county health board. Sounds more as if they're trying to determine HIS eligibility for some form of assistance. Which does not affect YOU at all.

    And FYI, unemployment compensation is not "free money without having to work". Brother, am I glad I never worked for you.

    While I do appreciate your legal advice as that is your field (I assume), I'm not sure what your experience is in the construction trade. Let me put it to you this way, there is nothing but work out there right now. So much that its tough to find new employees because everybody is working. I ask two things of my workers, take pride in your work and be reliable. Anyone who is a former employee of mine was short one or the other, or both. So please, don't judge what kind of employer I am, I take it rather personally.

    why would you not provide it? Doesn't matter why the state/county needs it. As employer, it is your duty to do so for the benefit of the former employee.

    You do not know it is for "free money" whatever tree that money grows on. If you are unhappy about "free money" then pursue that through your legislative system, not through withholding information about a former employee.

    Here's best business practice from SHRM: "Though not always clear cut, requests from federal and state government agencies and offices often require compliance, whereas most other requests do not. A request from a government agency often cites a regulation requiring the information; if not, employers can generally feel confident about sharing the information asked for, as a good faith effort to comply. These requests are often to verify wages for court decisions (such as child support) or government programs, to uncover fraudulent use of government services, or even to help an employee prove his or her identity was stolen. These requests are usually very specific in terms of the information needed, and again, any truthful information provided should not subject the employer to legal claims. "

    And you don't know what the employee(s) circumstances may be. You don't know if they've been injured, or a family member is ill. You don't know if a spouse has recently lost a job. You don't know if there are issues unrelated to what you can see that might result in it being difficult to find work. All you can see, based on your posts, is that someone is requesting assistance and you're not only taking it personally, you're assuming that in some way it's going to prove detrimental to YOU.

    I've got news for you. It's NOT all about you. Sometimes you might be asked to supply information that isn't related to you at all, other than the fact that you have the information. Not everything is always going to be because YOU are going to be affected.

    Thank you so much for your reply and the valuable information. I sincerely appreciate the insight and your time, that was exactly what I was looking for. I think some of these troll types don't realize the effort and liability that goes into running a small business. So many out there spend their lives looking for ways to take advantage of the system. If they only put that effort into honing a skill the world would be a better place. Thank you again!
