    Default If You Don't Give Notice to End Your Lease Does it Become Month-to-Month

    My question involves landlord-tenant law in the State of: Ohio

    I am a tenant and my lease calls for 90 day notice on the part of either landlord or tenant for both renewal/non renewal. It does not state any penalty or action that results in not providing sufficient notice (no automatic lease renewal, monetary penalty, etc.). At this point we are within 90 days of the lease end and no one has provided notice of any kind. What will happen at the end of the annual lease term? Does it automatically convert to month to month?

    Depending upon the terms of the lease, and assuming it's an annual lease, it most likely either renews for another year or becomes a month-to-month lease. The only way to get a certain answer is from somebody who has the opportunity to review the lease.

    You can also simply ask your landlord. If you agree with the landlord's interpretation, there won't be an issue.

    Agree.

    Depends on the terms and conditions of the lease.

    Read it.

    Some leases have an automatic extension provision specifying what happens at expiration.

    If it doesn't and, for example, you move on the last day of the lease, you could owe three months rent.

    I suggest you talk to your landlord and work this out.

    Sitting on your thumbs can end up being very expensive.

    Thanks! I have read it pretty extensively and it doesn't specify what happens. I was wondering if there was a default specified by law if nothing specified in the agreement itself.
