    Default How to Change Your Child's Last Name in Indiana

    My question involves name change laws in the State of: Indiana

    Me and my gf are looking to change her sons last name to mine, His father has never been there left as soon as he found out she was prego. Hes not even on the birth certificate, Only her on is on it...his current last name is her last name...She wants to put me on the bc,Give him his last name and include me in his co guardianship...how would we go about this ? He's not on the BC, Nor does he has his last name..the child is 2!

    The only legal way to go about it would be for you and your girlfriend to marry, and be married long enough to establish a solid marriage, and then, with either the consent of the biological father or the consent of the courts, you formally adopt the child in a stepparent adoption.

    You list three things in your post that are largely UNRELATED:

    Name Change
    Being on the birth certificate.
    Being a guardian.

    Steps on the name change procedure is here:
    As LL points out, you're not going to change the birth certificate without a formal adoption.
    As for being a legal guardian, again that will take court action that's not to be considered caprciously.

    On the other hand, there are a wealth of benefit for you and the child for just being a step parent. I helped raise two fine children from the ages of 3 and 6 without any of the above.

    And be aware, if you somehow manage to become the legal father, and you and Mom split up, you will - if she gets custody - be paying child support. Playing "musical daddies" is never a good idea.
