Default Lease Says Gas Included in Rent, Now Landlord Says It's Not

My question involves landlord-tenant law in the State of: Montana

We signed a lease at the start of June and finally moved in just the other day. We then found out our gas was turned off. I contacted the landlord who said gas is supposed to be paid by me but in the listing for the property, when talking with the landlord before signing the lease, and in the lease we singed, it states that gas water sewer and garbage are covered by the landlord and that electric is the only utility we pay. He says it was a clerical error and I will need to get gas restored to the unit and the billing put in my name.

Do I have right to refuse this and insist that it be paid by the landlord?

Yes, you can insist...you can even sue him and win if he refuses to do it. However, it is going to make for a very bad relationship with your landlord, he likely won't renew the lease at the end of the term and he is likely to play all kinds of games with your deposit. However, he is absolutely bound by the lease, just as you are.

Thank you for the reply. I'd definitely like to avoid a lawsuit over this. I'm trying to work something out and it sounds like we might be able to come to an agreement that I will put the gas in my name and pay it for a reduction in rent equal to the average monthly gas usage (about $40 per month). But it is good to know I have some solid legal ground to stand on here.
