    Default Is There a Limit on Rent Increases for Commercial Property

    My question involves landlord-tenant law in the State of: california

    Can your landlord increase your rent to 35% on a month to month lease on a building way over 50 years old? And can a landlord give you the letter on 6/29/2017, but date it for 6/1/2017 to increase on 8/1/2017 and tell us we need to respond to it by 7/1/2017

    Well of course they CAN because they DID. The question is whether or not they can enforce anything based on giving you the letter dated 28 days earlier.

    What does your month to month lease say?

    The sixty day notice requirement under Civil Code Sec. 1946.1 applies only to residential properties and only for residential tenants in residence for a year or more; so depending on what your written rental agreement says, the month's notice that you concede that you received may be sufficient to increase your rent.

    The age of the building is irrelevant.

    35% rent increase with a 28 day notice.
    Original lease started at $675 with a cpi 4% increase every year and cap at $750. It was a 5yr lease. And it got renewed for additional 5yrs after that. We have been there 11yrs since May of this year. We reach $702 then owner sold property with the conditions of keeping tenants in lease agreement. Lease expired, tried several times to get another lease. Owners would never contact us. Now on 6/29/2017 we were handed a letter, but they dated letter 6/1/2017, that rent will increase to $950 on 8/1/2017. And the rest of the lease would stay enforced. Letter said we also have till 7/1/2017 to agree or let them know if we are moving. Wondering is this legal for them to do this? And can they increase our rent by that much? This is what we started with

    Yes, it's legal. CA Civil Code 827a requires at least 30 days notice of a rent increase for non-residential leases or rental agreements. See:

    You were given proper notice.

    And yes they can increase your rent by 35% (or more) as there isn't any limit for commercial tenancies.

    And, yes, it was legal to ask you for your decision by 7/1. In fact, he didn't have to ask for your decision at all.

    CA Civil Code 1946 requires you to give 30 days notice of termination to the end of the rental period. See:

    If you didn't give termination notice on 7/1 for a move out by 7/31 then you are stuck paying $950 starting 8/1 until you give the proper 30 day notice.

    Reading what sent in link. 10% or less is 30 day notice. anything above what was mentioned in paragraph 2, is an additional 30 day. So they didn't give proper notice
