    Default What to Do if an Interstate Parole Transfer is Denied

    My question involves criminal law for the state of: MD/ PA

    My husband lived in PA his whole life but got in trouble in MD. He was incarcerated 15 years. He had to be released to the state of MD and is living with someone who he barely knows. His sister lives in PA, as do I, and we got married 4 months after his release.
    We share 2 kids as he adopted both of mine.

    He put in for an interstate parole transfer, and his Parole office was not very helpful. She told him he needed to use his sisters address even though he intended to live with me. We thought this was very odd, but she put it in at that address anyway.

    6 months go by and we finally got a notice from PA that his transfer was rejected because his sister never answered their calls, so they could not schedule a home visit.

    Can we reapply? Is there a way to get some legal action for this since the PO gave him false info (using a incorrect address)
    We dont know what to do. Our kids are enrolled in school in PA, and have been here 5, 10 years. I have lived in PA my whole life.
    We drive 2.5 hours every weekend to see each other and it is a pain.

    Any advice would be helpful, as his PO is now on maternity leave and he doesn't have another scheduled appointment until the end of August.

    A pain? Maybe it would be better to visit him in prison?

    Here's the advice: Your husband needs to hire a lawyer from whom he can get proper advice on his options.

    He should have done that in the first place instead of taking bad legal advice from the PO.

    Which, by the way, there is absolutely nothing your husband can do anything about.

    So obviously he lived in or was in MD at some point in his life...

    Ask the parole officer or a supervisor if you can reapply. Did he tell his sister that he put her address down and that they would call her?

    How did the PO give him false info? When I was with my ex husband still he put in for an interstate transfer. I didn't have an address yet as I was in the middle of moving so he used the address where we were living prior. He got approved. As he was told it's up to the state that you're requesting the transfer to whether or not they want to take on the responsibility. Then if the county wants to. He got his transferred between two counties because I divorced him after we moved.

    If his PO is on maternity leave then there will likely be someone handling her cases until she gets back. He can call her supervisor and find out what to do. He doesn't have to wait until a scheduled appointment.

    What you can do is worry about your kids for now. Perhaps you should have thought about this before marrying someone four months out of prison and on parole... (I was already married to my husband when he got probation and stupidly stayed with him after a dv incident fyi).

    Interstate Compact can be difficult lengthy and at times, denied by the receiving state. She used his sister's address because that blood relationship existed before his incarceration. You on the other hand, established your bond post release. If you were married prior to his arrest, it would have been a different story.
