    Default How Long Does it Take to Get Unemployment Benefits After Winning an Appeal

    My question involves labor and employment law for the state of: Kansas. After winning an appeal in KS, how long does it take to get your debit card/money. I have filed my weekly claims ad directed. It has taken 2 months to get to this point and my family is struggling.

    If it has been more than two weeks after your hearing, and after you have received a decision stating that you have been approved, I would suggest a call. There is a small adjustment that the adjudicator is supposed to make, when issuing a favorable decision, that releases your backpay. Sometimes, the person making the decision fails to do this, and it needs fixing.

    If you have been making the weekly certifications as directed, your money should be released fairly soon after the decision. But I'm not taking less than two days, okay? Likewise, two weeks would be an excessive amount of time for it to be delayed. People come in two flavors. Some will call the agency within twenty minutes of getting the decision, saying, "Okay, where's my money?" and some will sit there for two more months wondering where their money is without calling to check on it.

    But not getting your unemployment insurance while going through the appeals process is just the way it works. having to wait three weeks to receive the first check in a clean easy uncomplicated claim is standard. With an appeal and decision involved, two months is not at all excessive. Unemployment is not designed to keep the basic needs of a poor and needy family met, and while the agency is under certain reasonable constraints to get people paid what they are owed in a timely manner, it's not something you can sue them over or anything. Be very proactive in keeping up with what weeks you have been paid for, how many you are due and how long it has been since you actually your received notice of claim approval. If you think it's been too long without your being backpaid, call them and ask.
