    Post Four-year-old Indiana medical bill

    Is there a time limit on when a hospital can seek payment on a medical bill? I live in Indiana and I just received a bill from a hospital from 2003. I have never before seen this bill. Is there such a thing as a statue of limitations on when you can be billed?

    not to be negative but everybody says that. Just because you claim you didn't see the bill doesn;t mean the provider didn;t attempt to bill you.

    Before you get into an SOL situation, did you have insurance at the time of this procedure? Was the provider a member of a PPO or HMO (your insurance) "in network" group?

    Yes I had an in-network PPO insurance. I was supposed to have a procedure and the insurance agreed to pay for it. When the insurance company at the time found out that they may be losing the contract; they quickly and suddenly decided not to pay for the upcoming surgery. So 20 days before I was to have the procedure the insurance backed out and I ended up getting stuck paying close to $5,000.00 in pre op tests (which I am still paying for) because the insurance refused to pay those claims. I appealed to the employer, the employer's insurance compamy and the state medical board. The state came back saying that basically because they were a small company with less than so many employees they (the state) could not do anything about the insurance company's sudden change of mind.

    I am not one to ignore a medical bill; I follow through thouroughly and work out whatever payment plan fits my family's budget. This is clearly not just me sitting here saying "gee I am going to ignore this". I don't understand where this has come from and why after 4 years this bill has suddenly surfaced. I am just looking for some guidance on this. Thanks

    actually I believe this would fall under a written contract situation which has a 10 year statute of limitations in Indiana.

    The time line is a bit confusing and incomplete so rather than go back and forth with this, I will post what my thoughts were.

    If this was a PPO and an in network provider, if there was still a contract in place (between the provider and the insurance company) when the expenses were incurred, the time the hospital has to bill you would be guided by that contract.

    I obviously do not know what insurance company you have and surely have no idea as to it;s rules and coverages so I will use my insurance company as an example.

    The conract my insurance company enters into with a provider is set up such that the provider cannot bill me (an initial billing) no more than 1 year post procedure. They also cannot even bill me until an EOB has been generated by the insurance company.

    They are also required to bill any procedures within 1 week of the procedure or they are barred from billing either myself or the insurance company.

    If the contract situation comes into play, the hospital may have been bound by such a contract and billing you would be a breach of said contract. You will have to investigate this possibility.

    If there was no contract in place that placed any such requirements, the hospital has until 2013 to collect from especially considering you were aware of the situation at the time it was happening.
