    Default Can Your Roommate Throw You Out if You're Not on the Lease

    My question involves roommates.I'm having problems with my roommate. For the past year we've shared rent and all the bills. I paid half of her Netflix half of her Wi-Fi even though I have my own Netflix that I pay on my own I paid for half of all her stuff cause she put it on the list of bills.I don't even watch tv at all but anyways. Today is June 23 2017. I told her I wanted to get my own place. We live in Riverview fl and I work in Tampa. I asked her if it was ok for me to stay there until August 1st. But I told her I need to save money so I won't be able to pay for anything. Her daughter moved in on April with her son and husband. My roommate have a 13 year old son. That's allot of people. So i told her i wanted to get my own place she said she was ok with it. that i can stay till August 1st. I started looking for apartment and i just got the ok for one. All i need now is the money. With the two paychecks I'll get in July I'll have the money. I already have the deposit so we good there. Now she's dating a guy that according to her is rich and got he's own place in downtown. A condo. Now she tells me she wants me out by July 1st knowing i have no place to go and no money. All because her boyfriend is moving in. Now mind you no one knows who this guy is she don't even know his name. All she knows is what he tells her. That he's got money and he knows allot of celebrities. Meanwhile her daughter is not happy with this man moving in because if her 3 year old son. We don't know the guy. I gave her $100.00 . All I do is go to my room and stay there. I don't mess with anyone I don't bother anyone. Tell me what can I do please. Can she just throw me out just like that?

    No, not legally.

    You are apparently her sub-tenant and she is your landlord. That arrangement comes under the Florida landlord tenant statute which you should become familiar with no matter where you rent:

    What's pertinent to you now is the following section:

    It requires written notice by either party at least 15 days prior to the end of the rental pay period.

    But you still have to pay rent until your move out date or you can be served a 3 day pay or quit notice and then evicted through the courts.

    Using the first of the month as an example, it would be too late for her to give you notice for July 1. It would have to be for July 30 and you would have to pay rent for the month of July.

    Your notice to her would have to be given at least 15 days prior to July 30 but you would still have to pay rent for July.

    I suggest you give her written notice that you are moving out the end of July and attach a copy of the statute section, highlighting Paragraph 3.

    Advice for the future: Never do roommates. They are the kiss of death. Same goes for live-in boyfriends.

    Ok but what if I give her the letter saying I'm leaving and once I'm at work she decides to throw my stuff out and my little dog. What can I do then.

    Call the police.

    Then sue her for wrongful eviction.

    Ok thank you. I can replace anything except my dog. If anything happens to him I'll die. I lost my kids and my husband he's all I got left in life. Thank you for your advice.

    Find a place for your dog now. Maybe a friend or family member will take him on a temporary basis. Then get out what is most valuable to somewhere safe, and do the best you can. You friends new "boyfriend" situation sounds downright creepy, and the sooner you can get out, the better!
