    Thank you for that response, in other words you don't know what agrument you would use if you were a lawyer to oppose the return of a deposit/fee for a Jury trial. Or, perhaps there are no really reasons - just a lawyer wants to .
    If you were in court, you heard their arguments. If you were not, you can ask your lawyer or read the documents that they filed in opposition to the motion.

    Maybe the other counsel asked it not be returned if it is expected you have to pay anything to the other party. As such they may ask the monies be diverted to them for whatever payments they might be expecting.

    In that case the other party would want it refunded and put a lien on it. If it is not refunded the court keeps it; it doesn’t go to the other party.

    Then it makes no sense opposing counsel/party was even involved in the hearing. Based on your statement refunding or not has nothing to do with the opposing party.

    There are some circumstances in which it would make sense for the opposing side to contest the return of the jury fee. That’s why I asked the questions I did earlier.

    Our lawyer notified opposing lawyer our intent to ask for Jury trial refund - he could attend or not. Clerk of Court had not problem with it being refunded. However, the opposing lawyer came to the hearning & stated that his client didn't have an issue with it being refunded. However, he (their lawyer), didn't feel it should be refunded. The judge refunded it anyway.
