    Default Can a Judge Ban You From a Store Where You Shoplifted

    My question involves criminal law for the state of: Tennessee

    I was caught shoplifting last year in target, while in the holding room waiting on police the manager had me sign a 1 year no trespass for that store.
    But when I went to court and got placed on judicial diversion the judge asked me when I could return to target. And I replied "1 year" and he said "no, you are banned forever"
    So my question is, who do I believe? Target is popular in my family and I can only avoid it for so long because I'm extremely ashamed and embarrassed and I never shared my charges with anyone other than my husband. It was a misdemeanor charge and can be expunged from my record.
    So should I call the store and see if I'm banned for life? Or does that violate the no trespass?

    The judge told you 'forever'. It's a court ORDER, not a suggestion.

    If what the judge told you was put into an actual court order (which I think is rather unlikely) then the ban would be for life until such time as the court order was changed. If the judge just made the remark from the bench and it was not included in an order then the ban is simply however long Target wants it to be. So look at the orders that the court issued in your case and see if the ban is mentioned in them anywhere.

    I actually didn't get any sort of court order saying anything.
    To tell you the truth I didn't get any kind of written info about the terms of my judicial diversion (very unsupervised probation for one year)
    The only thing I have in my possession is the subpoena for court that I was given by the police officers at the time of my crime and my paperwork to fill out for my background check to see if I was eligible for diversion.
    I never got a court order for anything. So how would I go about finding out for sure?
    I can't contact the district attorney that I made a deal with because I've tried several times and I never get a response. And it's unlikely that the judge would take my call

    I doubt the DA or judge will ever answer your call. If there is no court order banning you from Target then you are only banned for a year.

    While you may not have been given copies of them, the court would have issued at least one order in the case. Go to the court and ask the clerk to see the court file or for copies of it. The orders will be in there.

    Even in the unlikely event that the judge put "banned for life" into the record of the conviction, the court's jurisdiction to enforce that provision would end when the defendant completes and is discharged from his or her sentence. Perhaps I'm overlooking something, but I can't think of a way that the disposition from a closed criminal file would override the position of a store as to who can or cannot visit its premises.

    Literally all that happened in court was that he told me to pay my court costs, do my diversion(probation) time, and then asked me how long I have to stay out of target to which I replied "1 year" and he told me no, forever. I didn't sign anything in court but I did sign the one year ban, in the store, on the date that I was caught shoplifting. I wasn't given any documents in court telling me I can't ever go back.

    You don't have to be given anything or sign anything.

    Again, you were told to go to the court and get a copy of the official decision/order signed by the judge.

    So let someone else in your family (who is not a thief) go to the store for you.

    OR go to another Target somewhere else.
