The former employer could do that anyway, if he was truly that sort. It would likely not be that hard to find out where the former employee is working now. On the other hand, failure to notify the employer is a breach of the agreement, and might cause him trouble as well if he doesn’t do it, especially if the guy is a vindictive jerk. In short, I do not see it as much more likely that the OP will have problems with the old employer causing trouble with the new employer by complying with the agreement he signed than if he doesn’t. The OP has been at the new employer for several months now. The new employer likely already has its own take on how good or bad an employee the OP is. That is likely to matter far more at this point than whatever the old employer might say.
I am sorry but I just do not agree with you on this one. I agree that technically the agreement requires him to do that, but I disagree that its more risky to not do it. Since the OP is not violating the non compete, there are no damages that the employer could articulate if the op does not comply.

I believe that notifying the employer at this point would just be handing a potentially malicious person the tools to make the OP's life more difficult.
