if someone hit someone with a lollipop would it be considered assault? or assault with a weapon?
Depends on the applicable state law and the exact facts of what happened. In the jurisdictions where I practice, this would either be a simple battery or aggravated battery depending on the degree of harm caused. Small bump on the head, simple battery. Take the victim's eye out, and it becomes an aggravated battery.
