    Default Workplace Punishment in Illinois

    Let's say that I work for a company, in Illinois. My manager at one point says I don't like you do your job the way I tell you, or you are fired. His communication methods are always using intimidation rather than explaination. He takes no responsibility to actually perform duties but gets others to do them for him.
    Anyway that is him. So here I am several months later and I am put on a plan that is intended to improve my performance. In that plan there are a few key elements, and it states that failure to follow them will result in immediate termination. Those elements are:
    • Need to go to three of my peers every week and get feedback on my performance. They even provided the questions I am required to ask my fellow employees. Of course, people want to know what this is in regards to because there is a standing policy that you cannot work on anything but what your manager gives you as an assignment. So I have to explain to them about being in trouble and that I need this to keep my job. Some even refuse and say it is inappropriate to answer these questions.
    • I also need to give daily written updates to my manager on how I have accomplished my daily goals and performed my responsibilities above what is expected of me.
    • I am on mandatory overtime. I am a salaried employee and this is supposed to be a professional environment. I was accused of not working overtime, but I have no way to prove that I did, other than my peers standing up for me.
    • I believe that one of these issues I am being written up for is related to a family emergency where a close member of my family died. It was said, "I was not capable of performing my duties and another person had to do them for me." It also mentions that persons name. That person was the person that took over my responsibilities during my family emergency. Prior to that, they were tasked with monitoring my work because their manager wanted to know what was going on with the project I was on, but they did not do my job for me.

    I spoke with my HR representative and I was told that I could fight this, but that it would only make life more difficult for me.
    I was also told by another employee that people like me were picked to trim the staff, that overall 10% of the employees will go through this method of torture before being terminated. So I am put on a plan that is suppose to give me the opportunity to improve, but it is predetermined that I will be fired.
    Most of the people I have talked to have told me that there is nothing I can do because of Work at will laws. I believe that would be true if they just wanted to fire me, but they have gone to the point of humiliation, degredation of character, intimidation, and double standards.
    I was told that I am failing to perform my interviews with my peers correctly, because they are not providing negative feedback. So I need to keep interviewing people until I get some, and I need to have it written in a report by next week. I was also told that it looks like I am fradulating the responses because there is no negativity in the responses and that just can't be true because I have problems and this does not show it.
    Any help would be great. I cannot afford to lose my job and the market is not well right now. Most of the people I know out of work, have been for at least 3 months. The average unemployement time is 4 months.

    While I do not even remotely agree with the way this situation is being handled, it is not violating any laws that I can see. So I can only suggest that you continue to try to work it out with your own HR department.
