    Default What to Do if a Car Salesman Takes a Cash Deposit Without Giving it to the Dealer

    My question involves a consumer law issue in the State of: MISSISSIPPI
    Would like to know if I could sue or bring a dealership to justice, after one of their salesman took my cash down payment of $300.00 and quiet working for the dealership the next day?
    The salesman did not enter the amount into the dealership's system, nor did he give me a receipt for my down payment.

    I'm guessing you mean he took your cash and "quit" the next day.

    Sure, you can sue the dealership.

    Do you have proof that you gave him $300 cash? You didn't get a receipt.

    Do you have any witnesses to the transaction?

    Without either of those, you'll probably be wasting your time with a lawsuit.

    Have you talked to his boss about it?

    With what result?

    Did you report the theft to the police? That might get you some action.

    Why on earth would you give someone you don't know money for a down payment and not get a receipt? Foolish.
    I'm not a lawyer, but I did stay at a Holiday Inn Express last night.......

    To prevail in a law suit you must be able to prove your claims.


    How can you prove you gave this salesman $300?

    if you can't, regardless of whether you did or didn't give him the money, you will not prevail in court.
