    Default Will Extradited Parole Violators Face New Charges When They Are Returned

    My question involves criminal law for the State of Colorado

    Hello,

    I'm hoping to find out what happens in the State of Colorado to parole violators who are extradited back to Colorado.

    Specifically, when someone with 63 days left of parole leaves the state without notifying his/her parole officer to seek help/asylum in Florida, where they live for two years until they are extradited back to Colorodo.

    Does this person simply return to Colorado to serve their 63 days of parole behind bars?

    Do they face new charges?

    Any information you can provide is greatly appreciated.

    Having 63 days of parole left does not mean that your penalty for a parole violation will be at most 63 days of incarceration. You can be resentenced for up to the maximum remaining prison term for your underlying crime -- the maximum penalty, with credit for time served. For example, if the crime is a five year felony, and you served two years before being paroled, you could potentially face up to three additional years of incarceration.

    Depending upon the facts, additional charges are possible. For example, if the person absconded from a Department of Corrections facility, such as a half-way house, they could be charged with the crime of escape.

    In addition to what Mr. K says, they can lock you up for 180 days (regardless of whatever other time you've accumulated) for the violation.

    You very well can face new charges for violating your parole. Or you can get a violation and spend time for that violation. Kind of up to your parole officer.
