Hello, as part of my severance I signed a Separation agreement with my former company we will call them Company X. There is a mutual non-disparagement clause in this separation agreement that reads:
WB_47 (me) will not make derogatory or disparaging comments about the performance, character, mission, competence, business plans or strategies, or reputation of company X, or their employees, officers, directors or other personnel. Company X will not make derogatory or disparaging comments about WB_47's (me) performance, character, mission, competence, business plans or strategies, or reputation.
I have recently learned that another employee at company X is going around bad mouthing me to a bunch of people in our field. My questions is, since this current employee still works at Company X could company X be considered in breech of this non-disparagement clause?
