    Angry Statutory Rape Laws in Alabama

    My question involves criminal law for the state of: Alabama.

    17-year-old has lived with a 22-year-old for one year. They broke up and now her mom is pressing statutory rape charges.

    Either the police will pick up the case, based upon whatever evidence they have that the adult broke Alabama Statutes, Sec. 13A-6-70, based upon sexual activity when the child was still 16... or they won't. If they do, the adult should consult a criminal defense lawyer. Alabama's "Romeo and Juliet law" age difference is two years, so the adult can't use that as a defense.

    Even if a parent knows that an adult is living with a minor, that does not mean that the adult cannot be prosecuted for sex offenses against the minor.
