My question involves criminal law for the state of: Indiana.
My nephew was pulled over last week after, according to police they witnessed him purchasing from a dealer they have been watching. He did indeed have a gram of marijuana that he purchased(first offense). They (police) asked if he would wear a wire to set the guy up and they wouldn't arrest him. Being afraid of getting arrested he immediately said yes. After getting home he thought it out and decided against it out of fear of bodily harm for him, his family or his children. The police showed up at his job(which is a new job) and proceeded to tell him once they took the marijuana back to the station they tested it to see if it was just marijuana and they found it was laced with fentanyl. My nephew had no knowledge of this as this was a dealer someone recommended him to.
They also proceeded to ask about wearing the wire again and he explained why he was uncomfortable with that. They called the original officer that pulled him over. He showed up and was rude and threw out some explicit sand said I'm not messing with you and proceeded to put handcuffs on him in his work parking lot charging him with a misdemeanor for possession and a 2nd charge of a felony with possession of marijuana laced with "cocaine" is what they called it. He was able to OR out of jail and we just don't know where to start. Any advice? First offense, has two toddler. It's. Money is very tight for this family. Please help.
