    Default When Can You Report Your Child as a Runaway

    My question involves juvenile law in the State of: NC

    Some issues have been going between my 17 year old daughter and CPS has advised I allow her to stay with my mother for the time being. The issue I have is that my mother's home isn't the best environment for my daughter, mentally or emotionally. I need to know what are the legalities of reporting her as a runaway to have her placed in transitional housing or out of home placement? If I report her as a runaway, what will come of the report? Will she be removed from her grandmother's?

    You have allowed her to remain at your mother's, so that doesn't really make her a runaway. If you want her to come back home, you go to your mother's and tell your daughter it's time for her to come home, and you collect her and bring her home.

    And, why is CPS involved? If there is already a case open, you may want to tread lightly. If you make a scene or use force to bring your daughter home, that may exacerbate whatever the issue is that got CPS involved in the first place. And if your mother's home was so bad, why'd you agree to this in the first place? How long has she been at your mother's?

    CPS is involved because my daughter said I was abusing her. It has been such a mess. She initially left when she wasn't allowed to get her way. CPS was going to place her in therapeutic foster care but because she took a DVO against me they approved my mother's house as fit because she passed a background check. The DVO was dismissed due to lack of evidence. I have been trying to have her removed from there but because my son was having problems also I thought it better for her to stay there until I could figure something else out. Her counselor is wanting to recommend transitional living for her but says the only way to do that is if I report her a runaway.

    She isn't a runaway though. Does your mother have temp custody via a court order or was her placement on an informal basis?

    Yeah, this is not really a "runaway" situation since you know where she is, and actually AGREED to the placement. You may well be able to go back and bring her home, but, that may cause problems of its own.
