    Default Landlord refuses to put in new carpet in Georgia

    I currently live in a 3 bedroom townhome. The carpet is the orginial carpet installed when the townhome was built in the late 80's. It is coming up from the steps and sides of each room. In some places there are gaps between the wall and the carpet where the carpet is coming up off their tackboards that are around 2 inches deep. My husband and I have fell down the steps due to the carpet on a number of occasions but townhome's managment says there is nothing wrong with the carpet. My husband and I have a four month old son who is going to be starting to crawl in the next few months and we are worried he will get ahold of the tackboards or the loss carpet and hurt himself. We have brought up the issue with management about installing new carpet months ago while I was pregnant but nothing resulted from our numerous requests. Is there some law that says landlords have to ensure the safety and well being of their tentants that I could use to get them to install new carpet? or does anyone have any advice on how I can resolve this matter....for my son's sake.

    Does your lease say anything about carpet replacement?

    This doesn't make your situation look very promising:

    The landlord may be responsible for fulfilling a verbal promise to replace the carpet. You would have to go to court, prove the promise was made and ask the court to enforce the promise. If there are no witnesses to the verbal agreement, and the landlord denies it, your ability to enforce the promise may depend on whether a judge believes you or your landlord. The better way to handle this type of situation is to have a written agreement as to any changes to be made. The landlord will be less likely to deny making such promises when they are in writing.

    The lease doesn't go into specifics of what will be replaced except that all repaires will be fixed in a timely manner. Would it be to my advantage to go to the county chamber of commerce to file a formal complaint? We just found out that there are other tenents in our complex that are having the same issues with the management. When I addressed the issue with management again this weekend she said that there is no way the carpet will be replaced. I told her that I would hate to withhold rent because of Managment's failure to fix a problem and she told me it was against the law to withhold rent.

    As previously indicated, "The landlord may be responsible for fulfilling a verbal promise to replace the carpet. You would have to go to court, prove the promise was made and ask the court to enforce the promise."
