    Default Will it Affect Custody or Support if a Parent Moves to Another State Before Divorce

    My question involves a marriage in the state of: GA

    I have been trying to divorce my husband for months, starting in February. He refuses to sign the papers though because he doesn't want to spend money on child support. He unfriended me on facebook, cut off all contact, and doesn't even try to see our son. I had filed for child support in March and waited on hearing from them. Then a couple weeks ago, he started asking how was my son doing (Which was fine by me). Then fast forward to this morning he told me that is he planning on moving in a couple of weeks to another state. He even said to don't worry about him seeing my son because he doesn't want to be bothered about it. But he hasn't signed the divorce papers and child support has yet to establish a case out of this. I swear he is doing this to get out of signing the divorce papers and child support.

    Will this affect my child support and divorce? Will it be impossible to get a divorce if he moves out of state? Can I get the divorce papers submitted without child support? (I just want it done and over with).

    If he won't sign, you'll need to go to court. Presumably, he's been served with both the divorce and child support papers. The onus is on him to show up. The judge will issue the various decrees whether he signs or not.

    If I wait till I get the money to afford a divorce (I just started on having a job), and he moves out of state, can I still be able to get a divorce? Will it get more difficult?

    Have you filed the papers yet (and have had him served)? Yes, it does make it difficult if he's not a resident of Georgia when you start the process. While you have venue in the Georgia courts, they may not be able to extend control on him out of state. Talk to your lawyer.
