    Default Can You Get Unemployment After Being Fired Over Disputed Allegations

    My question involves labor and employment law for the state of New Jersey. My employer received a complaint from a patient and I was asked to answer in writing. When I did and deny the accusations I was asked to wait suspended without pay until they decided what to do. My employer in other words told me that they did not want the complaint to proceed to the state level as they are a licences facility. I was then terminated although the complaint could not substantiated. I never received written warnings "write ups" and had a really good evaluation. Now that I'm terminated I was wondering if this could affect by UI benefits? Thank you

    You can apply for UI. If your former employer tries to have your claim denied, you can respond to the former employer's claims about why you were fired. As we have no way to evaluate the accusations against you or the evidence that might be provided in support of the allegations, we cannot promise you how the unemployment agency will resolve any dispute that your former emplyer may make.

    This is when you should have applied for UI. You didn't need to wait until your were "fired." You already were.

    There's only one way to find out and that's to apply. There is no penalty for being wrong and the worst that can happen is that you're turned down. In which case you're no worse off than if you never applied in the first place.
