    Default Can You Get a Subpoena Before You File a Court Case

    My question involves court procedures for the state of: CA

    I found this link on subpoena in small claim in California. http://www.courts.ca.gov/11162.htm. This may be a stupid question. But do you have to file you small claim complaint first to get a case number before you get a subpoena??? Question 2 is there a filing fee for a subpoena??? I know there is a filing fee for the small claim complaint filing but is there a separate fee for filing the subpoena???

    Yes, you have to file and get a case number first. Courts do not issue subpoenas without there being an underlying case to support it.
