    Default What Rent Do You Owe if a New Lease Starts Before the Old Lease Expires

    My question involves landlord-tenant law in the State of: CT

    Hi.

    Lease from April 1, 2016 > March 31, 2017 @ $1029/mo

    New 1 yr lease signed @ $1044/mo, but for some reason, the mgmt. co. wants to start the lease from the 3/28, as opposed to 4/1

    Showed up @ mgmt. office on 3/1/2017 with $1029
    Showed up @ mgmt. office on 3/28/2017 with $1044

    Now, the mgmt. co. is telling me that I owe them money. How much? A laughable $2 - but it's not the $ amt; it's the principle.

    It was explained to me that a prorate was done, and blah blah, I don't even understand it, but I owe them $2. The way I see it, they owe me money.

    If you prorate $1029 over 31 days, that's 33.19/day. Which means, that had I showed up @ mgmt. office on 3/1/2017 with $896, that would have covered me to the 27th, whereas the $1044 would be due on the 28th. But I didn't pay $896 - I paid $1029. Which seems to me that they owe me $133

    Am I doing this wrong, and are they in the right? Or....

    Ok, found out what it is. Originally, I was told by someone that I was paying rent from the 28th. Someone else has explained to me that no, I am paying rent from the 1st. So, the 28, 29, 20 and 31 was prorated at the higher rate, and the diff for those four days is $2. So, that makes sense. Too bad it wasn't explained to me properly the first time.

    The landlord appears to be taking the position that the new lease constitutes a novation in relation to the last few days of the old lease, such that rent for that period is payable at the new lease rate. That would make sense, perhaps, if the lease ends on 3/31/18, with 12 rent payments over the course of the lease. Without knowing more about what they are thinking, or why they wanted the 3/28 start date, I can only guess about what they're thinking (or if they're thinking). I personally don't know why the landlord is quibbling over $2, but if it were me I value my time above and beyond the $2 it will take to make the issue go away.
