    Default Can Someone Be Convicted of Rape if There is No Physical Evidence

    I got away and divorced my abuser 6 years ago. He raped me repeatedly. My contract ended honorably in the military and then I went into a battered woman's shelter. I reported it to them. I reported it to the VA who is pays mg due to PTSD and depression for it. I've been getting counseling for it since. I also reported it to legal aid but they said they couldn't afford to take on my case due to lack of funds. I thought I would be free of my abuser once I divorced him but he's made my life hell ever since. He's using the system and my kids to do it. I got away from him 6 years ago. My friend convinced me recently to call the police in nc where it happened and just talk to them and see. I never really thought of reporting it or thought anyone would believe me. The officer told me there is no statute of limitations in NC for this. I will be talking to an investigator soon. It probably be a he said she said case. I do have a ton of paperwork where I reported it to those places. I have no physical evidence not that physical evidence would prove anything since we were married. Can a person be convicted of rape without physical evidence? Am I wasting my time? I don't think he's ever gonna mg to live peacefully. We do have kids together.

    Neither the VA nor legal aid prosecutes criminals. You needed to report it to the state of NC (notably the police department in the area it occurred in). The fact YOU reported it to other places isn't evidence. The fact you've waited six years isn't going to help your case. The shelter did you no help by not encouraging you to report it immediately. Even criminal prosecution (if that was successful) wouldn't necessarily keep the abuser away from you. Hopefully the investigator can help you with other options as well.

    Yes, a person can be convicted but as you'd imagine without a confession the chances of a successful prosecution are not good. Please continue with your therapy, and focus on healing
