    Default Why Isn't a Sex Offender Showing Up on the Registry

    My question involves criminal law for the state of: Washington
    My ex is dating a convicted child molester, I have no evidence that the guy has been around my children and have been assured by my ex wife that he hasn't. However, I have continuesly looked at the sex offender registry to see if he has registered. His name has yet to show up. Of all the research I have done I was under the impression that any convicted sex offender must register. Is there something that would allow a convicted offender to not have to register? Or should I just report him?

    It matters what the exact offense was that he was convicted of committing and how long ago he was convicted. Not all sex crimes require registration, and even if registration was required, it may have only been required for a certain number of years, so it may be that his obligation to register is over. In short, the details are going to matter on this one.

    He was convicted of child molestation in the second degree, he was convicted back in December of 2016 so less than a year. If you need anything further please let me know

    The offense is a class B felony and should require him to register. If he has not, you can certainly mention this to his local law enforcement agency. However, it might be that his offense was deferred or dropped to a lesser category offense somehow and that may not require registration. I have no idea whether this is possible in WA, but it has been my impression over the years that most anything CAN (potentially) occur.

    I am surprised he is not in custody if he was convicted in December. That tells me that either he has yet to be sentenced (thus, perhaps no registration required), or there is some form of deferment going on here.

    If the conviction was just back in December, one very likely possibility is that the conviction is on appeal and that there is an order staying execution of the sentence until the appeal is heard. If the case is on appeal and he hasn't even started his sentence then he won't yet have to register.
