Does an Adult Child Have Any Special Protection Against Eviction by a Parent

Georgia does require a 60 day notice on the part of the landlord to terminate a tenancy at will. However, no reason for this termination need be provided by either side.

Georgia does tend to be a very landlord friendly state so it would not be unusual that a judge would grant the request from a parent to evict an adult child without this 60 day notice, especially if the parent were to prove the child was a lazy deadbeat who had worn out the good graces of the family.

I thought Georgia is (also) a tenant friendly state. What if the landlord/parent chooses to give a reason, but the reason becomes false and the tenant/adult child denies the false reason? So, the landlord/parent is allowed to give a false reason, rather than no reason, for the eviction without any evidence beyond his/her testimony?

At the end of the day, it comes down to this. You need to find another place to live while the process goes through it's paces and get out of this person's house. Sooner or later, they are going to get an eviction order. It would be in your best interest for future housing to leave on your own.

You aren't welcome there and you have known this for MONTHS. Are you even trying to find somewhere else to live?

The bottom line is; Unless the adult child is disabled and incapable of self-care (and possibly not even then) if the parent wants him out he's going to be out. No judge is going to force the parent to continue providing lodging for an adult, child or no. Nothing in the law says a parent has to continue providing care for a child once they are no longer a child. The ADULT can move out now voluntarily or he can move out later with an eviction on his record that will make it harder to him to find a new place, but he WILL be moving out.

The same applies to whoever it is about then. You should focus on helping them find alternate housing because they are going to be out, one way or the other. You playing armchair lawyer for them and trying to delay it does them a disservice.

The judge could also just choose to say, "Well, they don't really need a reason at all anyway" and grant the eviction anyway. The tenant child will still be out on their mooching ass, just a little bit longer. Good luck getting a new place to rent with a nice, fresh eviction on their record.

I find it difficult to believe, as many apartments, rooms, etc.. there are for rent in the ATL metro area and a big part of the rest of GA, that you have not been able to find this person alternate housing. What about your place?

I answered it. Just because you don't like it, doesn't change the fact that it is the way it will go. Reason, false reason, now or later....this person needs to get out of that house and quit playing games.
