    Default What to Do if You Don't Feel Safe With Your Ex- On the Lease

    My question involves landlord-tenant law in the State of: Montana.

    In march of 2016 my ex and I rented a trailer on a 6 month lease that then became a month to month lease. When we broke up he moved out without talking most of his stuff, won't take his name off the lease and wont give me his key. While he was never physically abusive his mental instability has made me fear for my safety there as he can still come and go as he pleases. I have no intention of moving out and can pay the rent on my own. What, if any are my options?

    Have the locks changed. Ask the landlord or hire a locksmith.

    Don't change the locks without the landlord's permission.

    If you entered into a six month lease back in March, 2016, the six months are long over. If that lease is continuing month-to-month, you can negotiate a new lease with your landlord, terminate the former lease, and continue your tenancy under the new lease that excludes your ex-boyfriend.

    Well doesn't that depend on what the lease says? Typically, you can change the locks at your own expense as long as you provide the landlord with a new key. Permission is better than no permission.

    If the lease gives the tenant permission to change the locks, that's permission.
