    Default What Happens if You Filed for Divorce But There is No Record of a Final Judgment

    My question involves a marriage in the state of Nevada, I filed divorce paperwork about 30yrs ago, in California where we both resides at the time, and was told if there is no objection from the other party it's finalized in 12 months. Never heard a word from anyone. Now 30 yrs later I was looking for a copy of Divorce Decree, and after a thorough search ( Reversing names,) no such record found. This means it's valid? Yes or No?

    If you went to court for a hearing on your case, laid the foundation for the entry of a judgment, submitted a judgment to the court for entry, and had the judgment entered by the court, then you should be able to obtain a judgment.

    If you filed a divorce case, assumed that it would be finalized after twelve months without further action on your part, and did nothing to establish on the record a foundation for the divorce or to secure entry of the judgment, odds are your case was dismissed for non-action without the entry of a divorce judgment.

    You can check with the court where you filed the divorce to see what action occurred on the case. Some courts have online dockets, but family law cases and older cases are often restricted or excluded from online dockets; you will likely have to work through a court clerk.
