    Exclamation Does the Court Calculated Child Support Includes Child Care Costs in California

    My question involves a child custody case from the State of: California

    Background:
    Never married to the mother, separated, the has 3 other kids with 3 other men. Still married to her last born kids dad, during the time we were together, she never divorced him.
    My only daughter is 2 1/2 years old and lives with her mother. After litigation the court awarded me little to non physical custody and 50/50 legal custody.
    The calculated amount of child support was set and the mother requested the court to have me pay for half of our daughters child care. I initially accepted due to the fact I felt compelled to think on my daughters best interest.

    I moved away to the State of Texas and modified the visitation to be able to spend one weekend with my daughter in CA, every third weekend of the month. I fly to LA, and spend the weekend with her on the court order terms.

    I am currently starting a business and trying make it and fulfill my responsibility. The mother often leaves our daughter to the Nanny and then takes off to have a leasure time with her new boyfriend, and she refused to disclose who this guys name was to verify if this new person was a sex offender or not. ( due to the several failed relationships, she has harbored. Including mine)

    I feel that I agreed to over pay. I am trying to see if the childcare its already included in the child support calculation and now I am paying for half of the child care for her to enjoy time that she could be instead, raising our daughter. I feel I should not be paying for her free days from our daughter so she can enjoy her time.

    I have tried to convince the judge she would have a better living standards with me in Texas, but the judge does not feel the same way. Judge Silberman in Pasadena Courthouse.

    I just want to know if I could negotiate to stop paying childcare, if its already included in my original hefty child support.

    Well, she's apparently popular with the men. Men like you.

    There's a bit of a difference between having some access and having none, no?

    She has no duty to tell you a single thing about the man/men she's dating. And yes, she's allowed to have "time off".

    I feel you should be as accurate as you can be when describing your situation. Your child is very young. You live in a different state. How do you know what Mom is doing, and at what times? Do you have an expectation that Mom shouldn't have down time? Help me out here, Dad.

    Thank you for letting us know who your judge is. Like all judges, Silberman has his supporters and his detractors. What I'm saying here is that we don't care who your judge is. Now. What changed since the original custody determination, in the child's life, to warrant the change of custody you filed?

    I just want to know if I could negotiate to stop paying childcare, if its already included in my original hefty child support.

    Look to your court order, and you will see what is and isn't included. If you feel you're paying too much, you are free to take the matter back to court and have the court decide for you.

    Your daughter's mother has one weekend a month that the child is with you in order for her to have a life outside of being a parent. While you get approximately 28 days a month to do whatever you feel like doing with whomever you feel like doing it with. Instead of sitting there and trying to figure out a way for you to not pay mom as much based on the idea that you don't think she should have a life outside of your daughter, perhaps you should be thanking her for taking care of almost all of the parenting responsibilities leaving you free to do as you please.

    She doesn't have to tell you who she's dating. She can leave the child with anyone she wants during her time. Why do you assume he's a sex offender?

    Childcare is not included in child support. They are separate in most cases I've seen including mine. In my divorce decree it states the monthly amount for child support and then says that we split unreimbursed medical and daycare 50/50. So you got what most people got in that you are responsible for half of daycare.

    It's not up to you how she spends time with your daughter. Should she be able to tell you how you should spend your time with your daughter? How would you be more suitable of a parent than her mother? What has changed to warrant you get custody? I'm not sure why you posted the judge's name. No one here cares about that.

    I very highly doubt you'll get the court to stop you from paying half of daycare. You can file to modify child support if it's too "hefty" to take care of your daughter. But it's odd that you live in another state yet you know everything your ex is doing in her spare time or daily.
