My question involves a child custody case from the State of: California
Background:
Never married to the mother, separated, the has 3 other kids with 3 other men. Still married to her last born kids dad, during the time we were together, she never divorced him.
My only daughter is 2 1/2 years old and lives with her mother. After litigation the court awarded me little to non physical custody and 50/50 legal custody.
The calculated amount of child support was set and the mother requested the court to have me pay for half of our daughters child care. I initially accepted due to the fact I felt compelled to think on my daughters best interest.
I moved away to the State of Texas and modified the visitation to be able to spend one weekend with my daughter in CA, every third weekend of the month. I fly to LA, and spend the weekend with her on the court order terms.
I am currently starting a business and trying make it and fulfill my responsibility. The mother often leaves our daughter to the Nanny and then takes off to have a leasure time with her new boyfriend, and she refused to disclose who this guys name was to verify if this new person was a sex offender or not. ( due to the several failed relationships, she has harbored. Including mine)
I feel that I agreed to over pay. I am trying to see if the childcare its already included in the child support calculation and now I am paying for half of the child care for her to enjoy time that she could be instead, raising our daughter. I feel I should not be paying for her free days from our daughter so she can enjoy her time.
I have tried to convince the judge she would have a better living standards with me in Texas, but the judge does not feel the same way. Judge Silberman in Pasadena Courthouse.
I just want to know if I could negotiate to stop paying childcare, if its already included in my original hefty child support.
