    Default What is Stalking

    My question involves criminal law for the state of: California

    What is stalking? Can a pickup artist get arrested for asking a woman he doesn't know out on a date? What if he accidentally asks her twice or more because he didn't recongnize her? I mean what if he asked her out years ago and didn't remember ever doing so and asks her out more than once. Is stalking asking a girl out on a date twice or more times?

    How does stalking relate to online dating? is asking a girl out twice or more when she said no the first time stalking? You see in online dating it is very hard to keep track of who you've contacted if you message a lot of girls.

    You see I read that a pickup artist was once arrested for approaching a girl in a store more than once on accident and the approaches years apart and was charged with stalking so I want to make sure that I never do the same or get arrested for the same.

    You see pickup artists don't mean any harm but they ask out a lot of girls and cannot remember every single one leading to possible asking out a girl twice because they don't recognize her.

    Thank you for the link. I am hoping that someone can answer the above question for me because that definition is too confusing to me and I would hate to be wrong and wind up in jail.

    (a) Any person who willfully, maliciously, and repeatedly follows or willfully and maliciously harasses another person and who makes a credible threat with the intent to place that person in reasonable fear for his or her safety, or the safety of his or her immediate family is guilty of the crime of stalking, punishable by imprisonment in a county jail for not more than one year, or by a fine of not more than one thousand dollars ($1,000), or by both that fine and imprisonment, or by imprisonment in the state prison.


    That's confusing to you? It's pretty clear cut.

    If you are intent upon engaging in contact that could land you in jail, you should hire a lawyer and discuss your planned course of action with the lawyer.

    Yes, you are a lazy thinker and are to slovenly to even read the statutes themselves, which are written in English, granted, multi-syllabic words that will require a robust lexicon will be used.

    Describe "pickup artist" in your terms. To me pickup artist means creeper who can't take no for an answer.

    If anyone tells you "stop contacting me" or "leave me the f*** alone"" and you don't, that's stalking and then harassment.

    How about you don't be a creeper and you have nothing to worry about.

    Under the right circumstances, it might be. Under MOST circumstances, it probably would not. Not in CA, anyway.

    Yes, you can be charged with stalking if you harass or annoy someone online. Again, the facts matter. At the very least, constant badgering online could be charged as an unlawful electronic communication if it is unwanted, harassing, repeated and against the recipient's will.

    Facts matter. I doubt it was quite that simple. You'd be surprised what details are NOT included in news stories, and if the story was some online blog or commentary, it was probably missing a LOT of relevant info.

    Then these "pick up artists" might want to avoid acting like snakes.
