My question involves landlord-tenant law in the State of: Florida
Over the 8 months of my boyfriend's lease, his landlord has violated his privacy multiple times by entering without giving reasonable notice (12 hours in FL under Statute 83.53). She/her maintenance guy has come in multiple times to inspect the property, which is fine, however she has never once told him or his 2 other roommates that she/maintenance guy was coming.
That aside, my boyfriend was recently diagnosed with severe anxiety and his psychologist has asked him about possibly getting a dog to relieve his anxiety because he isn't able to take anxiety medication for medical reasons. Although his leased property is a "no pets" property, he follwed the advice of his psychologist and adopted a 65-lb. cane corso who is the sweetest, most non-aggressive dog I've ever met. Anyway, his psychologist's office I guess is pretty busy this week and once he asked for the official note, the psych said it'd be about a week so he could fill out the paperwork and write the letter.
The day my boyfriend got the dog, the maintenance guy came (unannounced) and reported the dog to the landlord who said that the dog needed to be out immediately or else she would begin the process of evicting boyfriend. Boyfriend sent a text to landlord saying that she "legally needed to provide reasonable notice because you (she) has never done so in the past". The following day, maintenance guy was sitting in his truck outside of boyfriend's apartment. He didn't attempt to enter, but just sat outside I'm assuming waiting to see the dog to report again to landlord. Landlord then (finally) gave reasonable notice and said "(maintanance guy's name) will be by tomorrow (exact date) to check for any signs of the dog". Meanwhile, boyfriend is still waiting for the note. Dog comes over to my house to stay for the day so maintenance guy can come until boyfriend gets the written note but the mainentance guy never shows on the exact day she said he would.
Fast forward to today: boyfriend stayed at my place so the maintenance guy could come and expects that he's already came on the day landlord said he would, so he takes himself and the dog back to his apartment because my house already has 2 dogs and a cat and other people so it was getting crowded. Apparently the maintenance guy never came on the day landlord said he would and shows up today (unannouced) and sees the dog. Obviously, boyfriend is worried because although he does have a certified disability, he's just waiting for his psych to get the note to him to give to landlord.
My questions are this:
- Does he have any recourse to the constant lack of "reasonable notice"?
- Can the landlord try and evict him even though the dog is an "ESA" animal?
- Can she deny the ESA animal after he gets the note from the psych?
- Is there anything he can do to try and have recourse/damages against landlord if landlord does deny animal?
