    Default Can You Be Charged With MIP After an Accident With Beer in the Car

    My question involves an injury that occurred in the state of: VERMONT

    I was driving in Vermont when I hit black ice on the highway. I lost total control of my car, and it missed the guard rails of the highway, and flew off of the highway. I went through some snow before hitting a tree and totaling my car. I had a thirty beers which were packaged in the trunk of my car. When I hit the tree, the beers flew into the dashboard and exploded all over my body, as well as my car. I was amazingly unaffected by the accident; however, when an officer showed up he questioned me since I reeked of alcohol. I told him I was not drinking and the beers exploded in my car. I was then breathalyzed and blew zeros. I am 20 years old. The officer let me off with no charges. I was wondering if usually this would result in an MIP in Vermont. Was it lucky that I was let off with no charges? Also, the road conditions were unsafe, is the state liable for my crash? I was going the speed limit during the time of the incident; however, there were signs posted (not often) stating hazardous conditions.

    If you weren't written up on the scene for the MIP chances are you won't be. You could but I suspect the officer didn't note or let you off. Of course, they may show up later and serve you with a citation for the MIP or some traffic violations.

    The state is in NO WAY responsible for your bad driving. You need to anticipate road conditions and moderate your speed. The posted limit is only the prima facie unsafe speed in ideal conditions. The state is not going to post signs telling you it's cold in Vermont and when it is cold there may be ice on the road. By the way, secure your cargo next time so it doesn't become a hazard in a crash.
